Now known as The Manville Corporation, The Johns-Manville Corporation immediately filed for bankruptcy protection under the United States Bankruptcy Code in August 1982, following a landmark ruling which favoring retired boiler maker, James Cavett. The verdict in this case included what was then a record $2.3 million compensatory award, plus a $1.5 million in punitive damage award. "...The fibrosis of this disease is irreversible and permanent so that eventually compensation will be paid to each of these men. But, as long as the man is not disabled it is felt that he should not be told of his condition so that he can live and work in peace and the company can benefit by his many years of experience...".
Since this time, some of the largest asbestos manufacturers in the United States, including Amatex, Carey-Canada, Celotex, Eagle-Picher Industries, Forty-Eight Insulations, Manville Corporation, National Gypsum, Standard Insulation, Unarco and UNR Industries, have all declared bankruptcy in order to be protected from their creditors, and otherwise obtain the legal means to successfully fund the ever increasing number of Mesothelioma Claims, settlements and verdicts obtained in the Courts.
